Definitions

In these Terms & Conditions, the following terms have the meanings set out below unless the context otherwise requires:

Acceptance of Terms

By accessing any part of the pena88 platform, registering an Account, making a deposit, or placing a Wager, you acknowledge that you have read, understood, and agree to be legally bound by these Terms in their entirety. If you do not agree to any part of these Terms, you must not use the Platform.

These Terms constitute a legally binding agreement between you and pena88. Your continued use of the Platform following any published amendment to these Terms constitutes acceptance of the revised Terms.

Eligibility

To register and maintain an Account on pena88, you must at all times satisfy all of the following eligibility criteria:

• You are a natural person (not a corporation, trust, or other legal entity).
• You are at least 21 years of age. pena88 enforces a strict minimum age of 21 in accordance with internationally recognised responsible gaming standards applicable to the Indonesian market.
• You are acting on your own behalf and not as agent or representative of any third party.
• You are not a resident of a jurisdiction in which online betting or casino gaming is prohibited by applicable law.
• You are not an employee, contractor, director, or close family member of any employee or contractor of pena88 or any affiliated entity.
• You have not previously been excluded or banned from pena88 or any associated platform.
• You have not previously had a pena88 Account closed for violation of these Terms.

pena88 reserves the right to request proof of eligibility at any time. Failure to satisfy an eligibility verification request within the timeframe specified by pena88 may result in Account suspension pending resolution.

Account Registration

To access the full range of pena88 services, you must register an Account. The following conditions apply to Account registration and ongoing maintenance:

1. Accurate Information: You must provide accurate, complete, and current information during registration, including your full legal name, date of birth, residential address, and valid contact details. You must update this information promptly if it changes.
2. One Account Per Person: Each individual may hold only one pena88 Account. Registering, operating, or benefiting from multiple Accounts is prohibited and constitutes a material breach of these Terms, regardless of whether different contact details, payment methods, or devices are used.
3. Account Security: You are solely responsible for maintaining the confidentiality of your username, password, and any two-factor authentication credentials associated with your Account. pena88 is not liable for any loss or damage arising from your failure to keep your credentials secure.
4. Notification of Unauthorised Access: You must notify pena88 immediately if you have reason to believe your Account has been accessed without your authorisation. Contact pena88 support via live chat or at [email protected].
5. Non-Transferability: Your Account is personal to you and may not be transferred, sold, gifted, or otherwise assigned to any third party. Permitting a third party to access or use your Account constitutes a breach of these Terms.

Deposits

pena88 accepts deposits exclusively in Indonesian Rupiah (IDR) through the following approved channels:

• Bank Transfer: BCA, BRI, BNI, Mandiri, CIMB Niaga, OCBC NISP, BSI (Bank Syariah Indonesia), and Bank Permata.
• E-Wallet: OVO, DANA, GoPay, ShopeePay, and LinkAja.

The following conditions apply to all deposits made on pena88:

1. Deposits must be made from a payment account held in the Member's own name. Third-party deposits are not permitted.
2. Minimum and maximum deposit limits are published on the pena88 deposit page and are subject to change without prior notice.
3. pena88 does not charge a fee for processing deposits; however, your bank or e-wallet provider may apply their own transaction fees for which pena88 is not responsible.
4. Deposited funds are credited to your Account Balance following confirmation of receipt by pena88's payment processing systems. Processing times vary by payment method and are subject to the operating hours of the relevant bank or e-wallet provider.
5. pena88 reserves the right to conduct due diligence on any deposit and may request supporting documentation before crediting funds to your Account where the source of funds is unclear.
6. Deposits made in error cannot be reversed once credited to a pena88 Account. Contact support immediately if you believe a deposit was made in error.

Withdrawals

Members may request withdrawal of their real-money Account Balance at any time, subject to the following conditions:

1. KYC Completion: All withdrawal requests require completion of KYC verification. Members who have not completed KYC will be prompted to submit documentation before their first withdrawal is processed.
2. Matching Payment Method: Withdrawals must be made to a bank account or e-wallet registered in the Member's own name, matching the name on the pena88 Account. pena88 does not process withdrawals to third-party accounts.
3. Minimum Withdrawal Amount: A minimum withdrawal amount applies and is published on the pena88 withdrawal page. Requests below the minimum threshold will not be processed.
4. Processing Time: pena88 targets a withdrawal processing time of under 15 minutes for bank transfers to BCA, BRI, BNI, and Mandiri during standard banking hours (Monday–Friday, 08:00–21:00 WIB). E-wallet withdrawals to OVO, DANA, and GoPay are typically processed within minutes around the clock. Processing times may be longer during peak periods, Indonesian public holidays, or when additional verification is required.
5. Bonus Wagering Requirements: Funds derived from Bonus credits may not be withdrawn until applicable wagering requirements have been fully met. Attempting to withdraw Bonus Funds before meeting wagering requirements will result in the forfeiture of those Bonus Funds.
6. Right to Review: pena88 reserves the right to review any withdrawal request for compliance with these Terms, anti-money laundering obligations, and responsible gaming considerations. Reviews may extend processing times where additional documentation is required.

Bonuses & Promotions

pena88 offers a range of promotions including welcome bonuses, reload bonuses, cashback offers, free spins, and seasonal promotions tied to the Indonesian calendar (including promotions during Ramadhan, Idul Fitri, and Indonesian Independence Day on 17 August). The following general conditions apply to all pena88 bonuses:

1. Explicit Opt-In: No bonus is credited to a Member's Account without the Member's explicit opt-in at the time the promotion is offered. pena88 does not apply bonuses to Accounts without consent.
2. Specific Terms: Each promotion carries its own specific terms covering: the bonus amount or percentage; the applicable wagering requirement (the multiple by which the bonus amount must be wagered before withdrawal); eligible games and minimum odds; the bonus expiry period; and any maximum withdrawal cap on winnings derived from Bonus Funds.
3. Wagering Requirements: Wagering requirements are clearly stated in each promotion's terms before opt-in. A wagering requirement of, for example, 20x means the full bonus amount must be wagered twenty times before any Bonus-derived funds become withdrawable.
4. One Bonus Per Promotion Per Member: Each promotion is available once per eligible Member. Attempting to claim the same promotion multiple times using multiple Accounts or payment methods constitutes abuse and is prohibited.
5. Bonus Abuse: pena88 reserves the right to void any bonus, cancel associated winnings, and close an Account where bonus abuse, collusion, arbitrage betting, or any other conduct designed to exploit promotional terms is detected.
6. Modification and Withdrawal: pena88 reserves the right to modify or withdraw any ongoing promotion with reasonable notice. Promotions already claimed and in progress at the point of modification are subject to the terms that were in place at the time of opt-in.

Betting & Gaming Rules

The following general rules govern all wagering activity on pena88. Product-specific rules (e.g., sportsbook settlement rules, togel draw rules, live casino table rules) are published separately on the relevant product pages and are incorporated into these Terms by reference.

1. Bet Acceptance: All Wagers are subject to pena88's acceptance. pena88 reserves the right to refuse or limit any Wager without providing a reason.
2. Minimum and Maximum Stakes: Minimum and maximum stake limits apply to all Wagers and are displayed at the point of bet placement. Limits may vary by product, event, and market.
3. Finality of Settled Bets: Once a Wager has been settled and the result reflected in your Account Balance, settlement is final unless pena88 identifies a manifest error in odds, game outcome, or settlement calculation.
4. Manifest Errors: In the event of a manifest error (including but not limited to an incorrect price, incorrect game result, or system malfunction), pena88 reserves the right to void the affected Wager and return the staked amount to the Member's Account Balance. Winnings derived from a manifest error are not payable.
5. Network and Connectivity: pena88 is not responsible for any loss resulting from a Member's failure to complete a Wager due to connectivity issues, device failure, browser incompatibility, or power interruptions on the Member's side.
6. Platform Integrity: The use of software, bots, algorithms, or other automated tools to place Wagers on pena88 is strictly prohibited. pena88 employs detection systems to identify automated activity and will close Accounts found to be using such tools.

Prohibited Conduct

The following conduct is strictly prohibited on pena88 and constitutes a material breach of these Terms:

• Registering more than one Account on pena88.
• Providing false, misleading, or fraudulent information during registration or KYC verification.
• Using a VPN, proxy, or other tool to circumvent geographic restrictions or to misrepresent your location or identity.
• Using stolen, fraudulently obtained, or third-party payment methods to make deposits.
• Engaging in match-fixing, collusion with other players, or any form of cheating in any game or betting market on the Platform.
• Exploiting platform errors, software bugs, or miscalculated odds for financial gain without reporting the issue to pena88.
• Conducting, facilitating, or knowingly benefiting from money laundering or any other financial crime using the pena88 platform.
• Allowing any third party, including family members, to access or operate your Account.
• Using the pena88 platform for any purpose other than genuine recreational wagering.
• Threatening, harassing, or abusing pena88 staff, agents, or other Members via any communication channel.

KYC & Identity Verification

pena88 is required to verify the identity and age of Members before processing withdrawals and at any point where regulatory or risk-management considerations require it. The KYC process may require the submission of the following documents:

• Proof of Identity: A clear copy of a valid government-issued photo identification document — Indonesian National Identity Card (KTP), passport, or Driving Licence (SIM). The document must clearly show your full name, date of birth, and photograph.
• Proof of Address: A recent utility bill, bank statement, or official government correspondence displaying your full name and residential address, dated within the past 90 days.
• Proof of Payment Method: Where required, a copy of the bank card, bank account statement, or screenshot of the e-wallet account used to deposit, confirming that the payment method is registered in your name.

Documents must be submitted in JPEG, PNG, or PDF format. pena88 will process KYC submissions within 24–72 hours of receipt during business days (Monday–Friday, WIB). Members will be notified of the outcome via the email address registered on their Account.

Failure to complete KYC within the timeframe specified by pena88 will result in withdrawal processing being suspended. Your existing Account Balance is not forfeited during a pending KYC review, unless the review reveals a breach of these Terms.

Account Suspension & Closure

pena88 reserves the right to suspend or permanently close any Account at its reasonable discretion. Grounds for suspension or closure include, but are not limited to:

• Breach of any provision of these Terms.
• Failure to complete KYC verification within the specified timeframe.
• Reasonable suspicion of fraudulent activity, money laundering, or match-fixing.
• A Member's own request for self-exclusion under the pena88 Responsible Gaming programme.
• A court order, regulatory direction, or law enforcement request requiring the suspension or closure of the Account.

Where an Account is closed due to a breach of these Terms, any balance attributable to Bonus Funds or winnings derived from conduct in breach of these Terms will be forfeited. Real-money deposits not implicated in the breach will be returned to the Member's verified payment method following a review period.

Members who wish to voluntarily close their Account may do so by contacting pena88 support at [email protected]. All outstanding wagering activity will be settled before closure is completed.

Limitations of Liability

To the maximum extent permitted by applicable law, pena88 excludes liability for the following:

1. Gambling Losses: pena88 is not liable for any financial losses incurred by a Member as a result of wagering activity on the Platform. All Wagers are placed voluntarily and at the Member's sole risk.
2. Service Interruptions: pena88 is not liable for any losses arising from temporary or permanent unavailability of the Platform due to scheduled maintenance, unscheduled downtime, cyber-attacks, or force majeure events.
3. Third-Party Services: pena88 is not responsible for the performance, availability, or conduct of third-party payment providers (including BCA, BRI, BNI, Mandiri, OVO, DANA, GoPay, ShopeePay, or LinkAja) used in connection with the Platform.
4. Device and Connectivity: pena88 is not responsible for any loss or damage resulting from the Member's hardware, software, internet connection, or power supply.
5. Indirect Losses: In no event will pena88 be liable for any indirect, special, consequential, or punitive damages arising out of or in connection with a Member's use of the Platform, even if pena88 has been advised of the possibility of such damages.

Nothing in this clause limits pena88's liability for death or personal injury caused by its negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law.

Privacy

pena88 collects, processes, and stores personal data in accordance with its Privacy Policy, which is incorporated into these Terms by reference. By registering an Account on pena88, you consent to the collection and processing of your personal data as described in the Privacy Policy.

pena88 does not sell, rent, or otherwise transfer your personal data to unaffiliated third parties for marketing purposes without your explicit consent. Personal data may be shared with payment processors, KYC verification providers, and regulatory or law enforcement bodies where legally required.

You have the right to access, correct, and request deletion of your personal data held by pena88, subject to applicable legal retention obligations. To exercise these rights, contact pena88 at [email protected].

Responsible Gaming

pena88 is committed to promoting responsible gaming and minimising gambling-related harm. The following tools are available to all Members at no charge and can be activated from the Account settings at any time:

• Deposit Limits: Set daily, weekly, or monthly maximum deposit amounts. Limit reductions take effect immediately; increases require a 24-hour cooling-off period.
• Session Time Reminders: Configure alerts to notify you when you have been actively using the Platform for a specified duration within a single session.
• Cooling-Off Period: Temporarily suspend your Account for a defined period (24 hours to 6 weeks). During a cooling-off period, login is not possible and no marketing communications are sent.
• Self-Exclusion: Permanently exclude yourself from pena88. Self-exclusion requests are processed immediately and are irrevocable for a minimum period of 6 months. Contact [email protected] to request permanent self-exclusion.

Amendments to These Terms

pena88 reserves the right to amend these Terms at any time. Where amendments are material, pena88 will provide notice to registered Members via email to the address associated with their Account and/or via a prominent notice on the Platform, no less than 14 days before the amended Terms take effect.

For non-material amendments (such as corrections to typographical errors, clarifications of existing provisions, or changes required by applicable law with immediate effect), pena88 may update these Terms without advance notice. The "Last Updated" date at the top of this page reflects the date of the most recent revision.

Your continued use of pena88 after the effective date of any amendment constitutes your acceptance of the revised Terms. If you do not accept the revised Terms, you must cease using the Platform and may request Account closure by contacting [email protected].

Governing Law

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of the jurisdiction under which pena88 is licensed and incorporated.

pena88 operates under an international gaming licence and is committed to maintaining the standards required by its licensing authority, including player fund protection, fair game certification, and responsible gaming programme requirements.

Nothing in this clause affects any mandatory consumer protection rights that Indonesian residents may have under Indonesian law and which cannot be contractually excluded or limited.
